1. Scope

below for each individual order placed and contract concluded.

The online shop reserves the right to change the general terms and conditions, delivery and payment conditions as well as the data protection regulations. The version of the general terms and conditions applicable at the time of the order is decisive, which cannot be changed unilaterally for this order. 
Any natural or legal person who maintains a business relationship with Kil Epox Shop is referred to as a customer.  

2nd offer

The offer is aimed at customers residing/registered office in Switzerland. Deliveries are only made to addresses in Switzerland. The offer is valid as long as it is visible in the online shop and/or stocks last. Price and assortment changes are possible at any time. The images shown in advertising, brochures, in the online shop, etc. are for illustration purposes and are non-binding.

 

3rd order

The presentation of the products in the online shop is not a legally binding application, but a non-binding online catalog or a non-binding invitation to customers to order the product and/or service in the online shop.

An order is considered an offer to the online shop to conclude a contract.

After submitting the order, the customer automatically receives an acknowledgment of receipt that documents that the order has been received by the online shop. After receiving this confirmation of receipt, the customer can no longer change the orders and is bound to them.

The online shop is free to refuse orders in whole or in part without giving reasons. In this case, the customer will be informed and any payments already made will be refunded. Further claims are excluded. Products that are temporarily unavailable cannot be reserved.

4. Conclusion of contract

With the order via this website including the acceptance of these terms and conditions, the customer submits a legally binding offer to conclude a contract.
Once the order has been received, Kil Epox Shop will send out an order confirmation  by mail, which confirms that the customer's offer has been received by Kil Epox Shop. Orders placed are binding for the customer. Unless otherwise noted, there is no right of return or withdrawal.

The contract is concluded as soon as Kil Epox Shop sends a declaration of acceptance by email, in which the dispatch of the ordered products or services is confirmed.

Orders will only be delivered after full payment has been received and provided the goods are available. If, after conclusion of the contract, the ordered goods cannot be delivered or cannot be delivered in full, Kil Epox Shop is entitled to withdraw from the entire contract or part of it. If the customer's payment has already been received by Kil Epox Shop, the payment will be refunded to the customer. If payment has not yet been made, the customer is released from the obligation to pay. gegönnt gmbh is not obliged to make a replacement delivery in the event of a contract termination.

However, if the subject of the contract is a custom-made product or a special order, the contract comes into effect when the online shop accepts the order in writing.

The prices are in Swiss Francs,  unless otherwise noted, including Value Added Tax (VAT) and, if applicable, including an advance recycling fee ("ARF"). Technical changes, errors and misprints are reserved, in particular Kil Trading can make price changes at any time and without prior notice. The sales prices do not include any consulting and support services. 

The price in the online shop at the time of the order is decisive. 

If you buy from a European country, the VAT will be charged on import, which will be charged in that country.
Please note this when making your purchase so that you are not surprised by unwanted VAT/customs costs.

 

6. Payment Options

Payments must be made in Swiss francs.

1. prepayment
   The online shop may require payment in advance. In the case of prepayment, delivery will only take place after receipt of payment. The ordered products are not reserved until receipt of payment and may be out of stock in the meantime.

2. Electronic means of payment
   The means of payment are online banking, bank or postal transfer, credit card (Visa, Mastercard, American Express), PayPal.  

3. Purchase on invoice
   The Online Store may, at its sole discretion, offer payment on account (with or without an installment option). He can make this method of payment dependent on a positive credit check and other conditions determined at his own discretion (e.g. minimum age, Swiss place of residence). The customer has no entitlement to payment on account or payment in installments.

 

Kil Epox Shop reserves the right to refuse customers for any reason        to exclude individual payment options or to insist on payment in advance.  

 

7. Retention of Title

Ordered products remain the property of the online shop until full payment has been made. The online shop is entitled to make a corresponding entry in the  
 

8.Delivery variant

 

Delivery (parcel shipment / home delivery)

  delivered by post or courier service to the address specified by the customer in the order. Payment in advance, credit card or PayPal will be invoiced.  

 

The costs for home delivery are shown separately in the shopping cart, in addition to the price of the ordered products.

If the customer does not accept the ordered products on the agreed delivery date, the online shop can charge the customer for the delivery costs and activities incurred and reserves the right to withdraw from the contract.

If products are delivered with obvious damage to the packaging or the contents, the customer must immediately complain to the service provider (e.g. freight forwarder, post office) and refuse acceptance, without prejudice to their warranty rights. The customer is obliged to have a damage confirmation report from the service provider (e.g. freight forwarder, post office) handed over. All transport damage must also be reported to the online shop immediately.

In the case of delivery addresses without an access route or with difficult access, delivery will be made to the nearest access point or train station. If customers still want delivery to/from their home, they must bear the additional costs or pay them in advance.

Home delivery usually includes delivery of the order to the customer's apartment or house.  Home delivery does not include any other services, such as unpacking and assembling the purchased item, taking back packaging material, etc.
The delivery address must be in Switzerland and easily accessible by truck.

 

9. Delivery date

Further claims from delay in delivery or (partial) failure of the delivery are excluded.

Can the online shop use the provisional or fail to meet the delivery date agreed with the customer, the customer is entitled to cancel their order in writing. The cancellation is valid if it is received in writing by the online shop after the delivery date has expired and before the order is shipped. If the shipping of the order crosses with the cancellation letter from the customer, the customer can make use of their right of return. If she fails to do so, the contract is deemed to have been concluded.

With the confirmation of receipt of the order, the customer will be informed of a provisional delivery date. 

The delivery times specified in the online shop are non-binding. They begin to run from the time the order is placed or, in the case of prepayment, from the receipt of payment.
 

10.Return Policy

The customer is granted a right of withdrawal for 10 calendar days after receipt of the goods. The deadline is deemed to have been met if the customer sends the written revocation by email (info@epoxyresin-shop.ch) or letter (Kil Epox Shop, Breitschachenstrasse 5,9032 Engelburg) within the deadline. The revocation does not require justification.

Exercising the right of withdrawal leads to a reversal of the contract. The customer must return the goods within 10 calendar days in their original packaging, complete with all accessories and together with the delivery note to the return address given by Kil Epox Shop in the imprint. Returns to Kil Epox Shop are at the expense and risk of the customer. Any payment already made will be refunded to the customer within 30 calendar days, provided Kil Epox Shop has already received the goods back or the customer can provide proof of shipment.

Kil Epox Shop reserves the right to demand reasonable compensation for damage, excessive wear and tear or loss of value due to improper handling and to deduct the loss of value from the purchase price already paid or to invoice the customer.

No right of withdrawal is granted in the following cases:

If the contract has an element of chance, namely because the price is subject to fluctuations over which the provider has no control.

If the subject of the contract is a moveable item which, due to its nature, is not suitable for return or can spoil quickly;

If the contract relates to a movable item that is made to the consumer's specifications or is clearly tailored to personal needs;

If the subject of the contract is digital content and this content is not made available on a hard disk or if the contract is to be performed in full by both parties immediately;

If the contract relates to a service and the contract is to be fully performed by the provider with the prior express consent of the consumer before the withdrawal period has expired.

In the areas of accommodation, transport, delivery of food and beverages and leisure activities, if the provider undertakes, when concluding the contract, to provide the services at a specific time or within a specified period of time.

11. Notification of defects

Normal wear and tear and the consequences of improper handling or damage by the customer or third parties, as well as defects attributable to external circumstances, are not covered by the warranty. Likewise, the warranty for consumable and wear parts (e.g. batteries, rechargeable batteries, etc.) is waived.

It is also the customer's responsibility to check the ordered products immediately upon receipt and to report any defects or deviations from the order in writing to the online shop or Kil Epox Shop within 10 calendar days.

Kil Epox Shop excludes all liability, regardless of its legal basis, as well as claims for damages against Kil Epox Shop and any auxiliary persons and vicarious agents. In particular, Kil Epox Shop is not liable for indirect damage and consequential damage, loss of profit or other personal injury, property damage and pure financial loss of the customer. A further mandatory statutory liability remains reserved, for example for gross negligence or illegal intent.

13. Privacy

The online shop points out that the data recorded as part of the conclusion of the contract will be collected, processed and used to fulfill the obligation arising from the purchase contract. The data required for the provision of services and fulfillment of the contract can also be passed on to commissioned service partners (e.g. logistics companies, service partners, debt collection companies), including abroad in countries which may not have equivalent data protection. By agreeing to these terms and conditions, the customer agrees to this use of data.

14. Governing Law and Jurisdiction

The place of jurisdiction is Rorschach, unless the law provides for mandatory places of jurisdiction.
Swiss law is applicable to the legal relationship between the online shop and the customer, to the exclusion of conflict-of-law norms and the Vienna Sales Convention.
